The Dutch Administrative Jurisdiction Division has upheld the publisher&#8217;s appeal, effectively overruling the decision handed down by The Court of The Hague in 2020.<\/p> <p>The Hague had previously decreed that EA broke Dutch gambling laws via the sale of in-game FUT packs, fining the <em>FIFA<\/em> publisher a hefty \u20ac500,000 for each week it continued to sell the digital add-ons, with a maximum penalty fixed at \u20ac10 million. EA chose to call the ruling&#8217;s bluff, filing for appeal and continuing to sell the digital trading cards in the meantime.<\/p> <p>A risky endeavor that has paid off (quite literally.)<\/p> <p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-311945\" src=\"https:\/\/jbsgame.com\/wp-content\/uploads\/2022\/03\/fifa-court-ruling-fine-overruled-dutch-fut-2.jpg?resize=640%2C336\" alt=\"ea fifa fut court ruling dutch fine\" width=\"640\" height=\"336\" srcset=\"https:\/\/jbsgame.com\/wp-content\/uploads\/2022\/03\/fifa-court-ruling-fine-overruled-dutch-fut-2.jpg?resize=640%2C336?w=1200 1200w, https:\/\/jbsgame.com\/wp-content\/uploads\/2022\/03\/fifa-court-ruling-fine-overruled-dutch-fut-2.jpg?resize=640%2C336?w=300 300w, https:\/\/jbsgame.com\/wp-content\/uploads\/2022\/03\/fifa-court-ruling-fine-overruled-dutch-fut-2.jpg?resize=640%2C336?w=768 768w, https:\/\/jbsgame.com\/wp-content\/uploads\/2022\/03\/fifa-court-ruling-fine-overruled-dutch-fut-2.jpg?resize=640%2C336?w=1024 1024w\" sizes=\"(max-width: 640px) 100vw, 640px\" data-recalc-dims=\"1\" \/><\/p> <p>On Wednesday, <a href=\"https:\/\/www.eurogamer.net\/articles\/2022-03-09-eas-10m-dutch-fifa-loot-box-fine-has-been-overturned\" target=\"_blank\" rel=\"noopener\">as reported by Eurogamer<\/a>, The Dutch Administrative Jurisdiction Division \u2014 essentially the highest order of law in the Netherlands \u2014 decided that the purchasing and opening of FUT packs did not qualify as &#8220;an isolated game,&#8221; and that it was an element of chance voluntarily utilized as a part of a &#8220;game of skill&#8221; (<em>FIFA<\/em> itself).<\/p> <p>&#8220;The vast majority of packs are obtained by and used for game participation,&#8221; <a href=\"https:\/\/www.raadvanstate.nl\/actueel\/nieuws\/@130206\/dwangsom-onterecht-opgelegd-loot-boxes\/\" target=\"_blank\" rel=\"noopener\">ruled the court.<\/a> &#8220;Since the packs are not a standalone game, they are not a game of chance and do not require a licence. The publisher has therefore not violated the Games of Chance Act and the Gaming Authority should therefore not have imposed a penalty payment on the publisher. In the summer of 2022, a scandal dubbed &#8220;EAGate&#8221; saw employees <a href=\"https:\/\/jbsgame.com\/ea-continues-to-investigate-eagate-publisher-confirms-employee-accounts-used-in-fifa-ultimate-team-scandal\/\" target=\"_blank\" rel=\"noopener\">selling high-ranking FUT cards &#8220;under-the-table&#8221;<\/a> for ludicrous amounts of money. More recently, it seems more and more likely that EA and FIFA itself are <a href=\"https:\/\/jbsgame.com\/after-thirty-years-ea-and-fifa-might-be-parting-ways\/\" target=\"_blank\" rel=\"noopener\">scheduled to part ways<\/a>, with the former rumored to be considering a full rebrand, following the <a href=\"https:\/\/jbsgame.com\/fifa-license-ea-report-football-soccer-electronic-arts\/\" target=\"_blank\" rel=\"noopener\">alleged doubling<\/a> of the latter&#8217;s licensing fee.<\/p> <p>For decades, <em>FIFA<\/em> has been one of the most financially lucrative franchises in all of gaming.
